Nature & circumstances of offence
  1. Contrary to clause 23 of Standard 3.2.2, Food Standards Code, the defendant failed to take all practicable measures to ensure that single use items, namely white Styrofoam boxes and pizza boxes intended to come into contact with food, were protected from the likelihood of contamination until use. Section 21(1) – Food Act 2003
  2. Contrary to clause 11 of Standard 3.2.2, Food Standards Code, the defendant failed to ensure that food for disposal, namely a two litre container of cream marked with use by date of 14 January 2008, which was stored on the food preparation bench at a temperature of 26.8 degrees Celsius and reasonably suspected of not being safe or suitable, was not held and kept separate until it was destroyed or otherwise used or disposed of so, that it could not be used for human consumption. Section 21(1) – Food Act 2003.
  3. Contrary to clause 10(2) of Standard 3.2.3, Food Standards Code, the defendant failed to ensure that floor tiles were able to be effectively cleaned, were unable to absorb grease, food particles or water, were laid so there was no ponding of water and to the extent that was practicable, be unable to provide harbourage for pests. Section 21(1) – Food Act 2003
  4. Contrary to clause 24(1)(d) of Standard 3.2.2, Food Standards Code, the defendant failed to take all practicable measures to prevent the entry and harbourage of pests on the food premises. Section 21(1) – Food Act 2003.
  5. Contrary to clause 21(1) of Standard 3.2.2, Food Standards Code, the defendant, failed to maintain floor tiles at the premises in a good state of repair. Section 21(1) – Food Act 2003.
  6. Contrary to clause 6(1) of Standard 3.2.2, Food Standards Code, the defendant failed to store food in such a way that it was protected from the likelihood of contamination. Section 21(1) – Food Act 2003.
  7. Contrary to clause 19(1)(c-f) of Standard 3.2.2, Food Standards Code, the defendant failed to maintain a standard of cleanliness where there was no accumulation of food waste, dirt, grease and other visible matter, namely:
    1. floors of the premises;
    2. walls of the premises. Section 21(1) – Food Act 2003.
  8. Contrary to clause 19(2) of Standard 3.2.2, Food Standards Code, the defendant failed to maintain fixtures, fittings and equipment to a standard of cleanliness where there was no accumulation of food waste, dirt, grease and other visible matter, namely:
    1. food storage hood in the pizza kitchen;
    2. refrigerator seal;
    3. can opener;
    4. shelves;
    5. pizza preparation bench.

  9. Contrary to clause 21(1) of Standard 3.2.2, Food Standards Code, the defendant, failed to maintain the premises in a good state of repair having regard to its use, namely:
    1. Back Kitchen wall;
    2. Back kitchen ceiling. Section 21(1) – Food Act 2003.
