Nature and circumstances of offence

The defendant, in respect of section 17(2) of Food Act, sold food that was unsuitable:

  1. Delivered for sale alcoholic spirit labelled as “Veruscha Vodka” did contain non-potable alcohol with tertiary-Butanol, which is a chemical agent foreign to the nature of the food.
  2. Delivered for sale alcoholic spirit labelled as “Hunters Brandy” did contain non-potable alcohol with tertiary-Butanol, which is a chemical agent foreign to the nature of the food.
  3. Delivered for sale alcoholic spirit labelled as “Mudgee Rum” did contain non-potable alcohol with tertiary-Butanol, which is a chemical agent foreign to the nature of the food.
  4. Delivered for sale alcoholic spirit labelled as “Mississippi Bourbon” did contain non-potable alcohol with; tertiary-Butanol, isopropyl tertiary-butyl ether, and trans-anethole that are chemical agents foreign to the nature of the food.

The defendant, in respect of section 18(3) of Food Act, sold food that was packaged and labelled in a way that falsely described the food:

  1. Delivered for sale food labelled as “Veruscha Vodka”. The food was not Vodka because it was not produced by distillation of food sources, so as to have a neutral taste, aroma and characteristics generally attributable to vodka as it contained non-potable alcohol denatured by tertiary-Butanol.
  2. Delivered for sale food labelled as “Hunters Brandy”. The food was not Brandy because it was not produced by distillation wine, or fermented preparations of grapes or grape products, so as to have the taste, aroma and other characteristics generally attributable to brandy as it contained non-potable alcohol denatured by tertiary-Butanol.
  3. Delivered for sale food labelled as “Mudgee Rum”. The food was not Rum because it was not produced by distillation of fermented liquor derived from sugarcane products, so as to have the taste, aroma and other characteristics generally attributable to rum as it contained non-potable alcohol denatured by tertiary-Butanol.
  4. Delivered for sale food labelled as “Mississippi Bourbon”. The food was not Bourbon because it was not produced by distillation of fermented liquor derived from not less than 51 percent corn, rye, wheat, malted barley, or malted rye grain, so as to have the taste, aroma and other characteristics generally attributable to bourbon whisky as it contained:
    ​​​
    1. the non-potable alcohol tertiary-Butanol;
    2. isopropyl tertiary-butyl ether;
    3. trans-anethole;
    4. a maturation related congeners profile inconsistent with bourbon whisky; and
