Nature and circumstances of offence

The defendant was convicted of the following offences for breaches under section 21(1) of the Food Act 2003, for failing to comply with Food Safety Standard 3.2.2 of the Food Standards Code, namely:

  1. Clause 17(1)(b) fail to maintain a supply of soap or other items that may be used to thoroughly clean hands at or near the hand basin in the staff bathroom.
  2. Clause 17(1)(d) fail to provide single use towels or other means of effectively drying hands that are not likely to transfer pathogenic microorganisms to the hands at or near the hand basin in the staff bathroom.
  3. Clause 6(1)(a) fail to store food in such a way so that it is protected from contamination.
  4. Clause 19(1) fail to maintain premises to a standard of cleanliness where there is no accumulation of food waste, dirt, grease, or other visible matter.
