Nature and circumstances of offence

The defendant was convicted of the following offences for breaches of section 21(2) Food Act 2003, in that the defendant sold food that did not comply with the requirements of Standard 1.3.1 of the Food Standards Code:

  1. On 20 November 2017, did sell minced meat described as "Gourmet mince" containing the preservative sulphur dioxide. Sulphur dioxide was present at a level of 370 mg/kg. Standard 1.3.1 -3(1)(a) and Schedule 15 of the Food Standards Code does not allow the addition of sulphur dioxide preservative to this food.
  2. On 20 November 2017, did sell minced meat described as "Normal mince" containing the preservative sulphur dioxide. Sulphur dioxide was present at a level of 1000 mg/kg. Standard 1.3.1 -3(1)(a) and Schedule 15 of the Food Standards Code does not allow the addition of sulphur dioxide preservative to this food.
