Nature and circumstances of offence

YDR Hospitality Pty Ltd
The defendant as convicted on two (2) offences against Section 16(2) of the Food Act 2003 (NSW) – Sale of Unsafe Food. The food sold was unsafe in that it contained Salmonella Reading and caused illness to guests when consumed.

The defendant was also convicted for seven (7) offences against Section 21(1) – Fail to Comply with the Food Standards Code for:

  • Cleanliness of fixtures, fittings and equipment
  • Cleanliness of food premises (form 1)
  • Food contact surfaces not clean and sanitary (Salmonella Reading)
  • Not preventing entry of pests (form 1)
  • Not preventing harbouage of pests
  • Not storing food so it is protected from contamination (Salmonella Reading)
  • Eating and drinking utensils not clean and sanitary
  • Maintance of fixtures fittings and equipment
  • 2 offences of failure to prevent the likelihood of food being contaminated (1 offence place on a form 1)
