Nature and circumstances of offence

The defendant was convicted for offences under section 21(1) of the Food Act 2003, failure to comply with the Food Standards Code, namely:

1. Offence date: 11 April 2024

  • Clause 6(1)(a) failure to store food in such a way that it is protected from the likelihood of contamination. $1,500
  • Food Safety Standard 3.2.2 Clause 7(1)(b)(i) failure to take all necessary steps, when processing food, to prevent the likelihood of food being contaminated. $1,500
  • Food Safety Standard 3.2.2 Clause 19(1). Failed to maintain food premises to the required standard of cleanliness. The floor areas throughout the facility contained accumulated food waste, dirt, dust, and other visible matter. $4,000
  • Clause 19(2) failure to maintain all fixtures, fittings and equipment, having regard to its use, to a standard of cleanliness where there is no accumulation of garbage, recycled matter, food waste, dirt, grease or other visible matter. $1,500
  • Food Safety Standard 3.2.2 Clause 20(1)(b) failed to ensure the food contact surfaces of equipment are in a clean and sanitary condition whenever food that will come into contact with the surface is likely to be contaminated. $1,500
  • Food Safety Standard 3.2.2 Clause 21(1) failure to maintain food premises and all fixtures, fittings and equipment, having regard to their use, in a good state of repair and working order having regard to their use. $4,000
  • Food Safety Standard 3.2.2 Clause 24(1)(b) failed to take all practicable measures to prevent pests from entering the food premises. $2,500
  • Food Safety Standard 3.2.2 Clause 24(1)(c) failed to take all practicable measures to eradicate and prevent pest harbourage at the food premises. $6,000

  • Clause 19(1) failure to maintain food premises to a standard of cleanliness where there is no accumulation of garbage, recycled matter, food waste, dirt, grease or other visible matter. $4,000
