The defendant was convicted for the offence under section 21(1) of the Food Act 2003, failure to comply with the Food Standards Code, namely:

1. Food Safety Standard 3.2.2 Clause 6(l)(a). Failure to store food in such a way that it is protected from the likelihood of contamination.
2. Food Safety Standard 3.2.2 Clause 17(l)(a). Failure to maintain easily accessible hand washing facilities.
3. Food Safety Standard 3.2.2 Clause 19(1). Failure to maintain the food premises to a standard of cleanliness where there is no accumulation of food waste, dirt, grease or other visible matter
4. Food Safety Standard 3.2.2 Clause 19(2). Failure to maintain fixtures, fittings and equipment to the required standard of cleanliness.
5. Food Safety Standard 3.2.2 Clause 21(1). Failure to maintain fixtures, fittings and equipment in a good state of repair and working order having regard to their use.
6. Food Safety Standard 3.2.2 Clause 24(l)(b) and (c). Failure to take all practical measures to prevent pests entering the premises and failure to take all practical measures to eradicate and prevent the harbourage of pests on the premises.
7. Food Safety Standard 3.2.3 Clause 15(1). Failure to have adequate storage facilities for the storage of items likely to be the source of contamination.
